Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Hunk, including the Hunk website, dashboard, API, command line tools, hosted hunk sites, and related services (collectively, the "Services"). These Terms are an agreement between you and 851 Inc. ("851 Inc.", "Hunk", "we", "us", or "our").

1. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

2. Accounts and Workspaces

Some features require you to sign in with a supported identity provider, such as Google. You agree to provide accurate account information and to keep your account, browser session, CLI tokens, and other credentials secure. You are responsible for activity that occurs through your account or workspace.

3. Use of the Services

Hunk lets users upload, deploy, manage, and serve static websites and related assets through workspace-scoped hunks. Hunks are workspace-visible by default, and users may choose to make certain hunks public.

You agree not to use the Services to:

  • Violate any law or regulation.
  • Infringe, misappropriate, or violate the rights of others.
  • Upload malware, malicious scripts, phishing pages, or deceptive content.
  • Interfere with or disrupt the security, performance, or availability of Hunk.
  • Attempt to access accounts, workspaces, hunks, systems, or data without permission.
  • Copy, sell, resell, or exploit the Services without our written permission.

4. Your Content

You are responsible for the content you upload, publish, or otherwise make available through Hunk, including HTML, CSS, JavaScript, images, prompts, generated output, and other static assets ("User Content"). You represent that you have the rights needed to use and publish your User Content through the Services.

Public hunks may be accessible to anyone with the URL or anyone who can discover the public site. Workspace-visible hunks are intended for authorized workspace users, but you should not upload sensitive information unless you are comfortable using Hunk to host or process it.

5. License You Grant Us

You grant Hunk a non-exclusive, worldwide, royalty-free license to host, store, copy, display, transmit, process, modify, and otherwise use User Content as needed to provide, maintain, secure, support, and improve the Services; comply with law; and enforce these Terms.

6. Hunk Intellectual Property

851 Inc. owns Hunk and the Services, including our software, branding, names, logos, designs, and other intellectual property. Except for rights expressly granted in these Terms, we reserve all rights in the Services.

7. DMCA and Takedown Requests

We respect intellectual property rights. If you believe content hosted through Hunk infringes your copyright or trademark rights, send a notice to hello@851.sh with enough information for us to identify the material and evaluate your request.

Your notice should include your contact information, a description of the work or mark you believe has been infringed, the URL or location of the allegedly infringing material, a statement that you have a good faith belief that the use is not authorized, and a statement that the information in your notice is accurate.

8. Service Availability and Limits

We may modify, suspend, rate limit, or discontinue parts of the Services at any time. We do not guarantee that the Services will be uninterrupted, secure, or error-free.

9. Disclaimers and Limitation of Liability

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, 851 Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or use.

10. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless 851 Inc., its affiliates, and its personnel from claims, losses, liabilities, damages, costs, and expenses, including attorneys' fees, arising from your use of the Services, your User Content, or your violation of these Terms.

11. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of California, excluding its conflict of laws rules. The parties agree to first try to resolve any dispute informally for 30 days. If the dispute is not resolved, it will be resolved by arbitration through the American Arbitration Association's International Centre for Dispute Resolution under its Expedited Commercial Rules. Arbitration will be conducted in English in Santa Clara County, California.

12. Termination

We may suspend or terminate access to the Services if we believe you violated these Terms, created risk for Hunk or others, or used the Services in a harmful way. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

13. Changes to These Terms

We may update these Terms from time to time. If we make changes, we will post the updated Terms on this page and update the effective date. Your continued use of the Services after changes become effective means you accept the updated Terms.

14. General Terms

If any provision of these Terms is found invalid or unenforceable, the rest of the Terms will remain in effect. Our failure to enforce a provision is not a waiver. We will not be liable for delay or failure to perform due to events beyond our reasonable control.

15. Feedback

If you send feedback or suggestions, you grant us the right to use them without restriction or compensation to you.
